Agreement to Terms

By accessing or using VoiceBit, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this app.

These Terms of Service constitute a legally binding agreement between you and VoiceBit Inc. regarding your use of the VoiceBit mobile application and related services.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the app and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Acceptable Use

You agree to use VoiceBit only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the app in any way that violates any applicable national or international law or regulation
• Transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• Impersonate or attempt to impersonate VoiceBit, a VoiceBit employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the app
• Use the app in any manner that could disable, overburden, damage, or impair the app
• Use any robot, spider, or other automatic device to access the app for any purpose
• Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful

Content Guidelines

VoiceBit allows you to create, upload, and share voice recordings and multimedia content. You retain all rights to your content, but you grant us a license to use, store, and share your content as necessary to provide our services.

You are solely responsible for the content you create and share. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit functionality
• Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity
• Violates the privacy or publicity rights of another person

Intellectual Property Rights

The app and its entire contents, features, and functionality are owned by VoiceBit Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our app, except as necessary to use the app for its intended purpose.

Subscription and Payments

VoiceBit offers both free and premium subscription plans. Premium features require a paid subscription, which will be billed on a recurring basis according to the plan you select.

All payments are processed through the Apple App Store or Google Play Store, and are subject to their respective terms and conditions. We do not store your payment information.

You may cancel your subscription at any time through your App Store account settings. Cancellations will take effect at the end of the current billing period.

Termination

We may terminate or suspend your account and bar access to the app immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the app and delete your account through the app settings.

Limitation of Liability

In no event shall VoiceBit Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the app
• Any conduct or content of any third party on the app
• Any content obtained from the app
• Unauthorized access, use or alteration of your transmissions or content

Disclaimer

Your use of the app is at your sole risk. The app is provided on an "AS IS" and "AS AVAILABLE" basis. The app is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco, California.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
